1. General Provisions
1.1 Acceptance
These Terms of Use govern your access to and use of the BON Influence platform. By registering on the Platform, creating an account, or using the Service, you declare that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and the Subscription Agreement where applicable.
1.2 Definitions
"User" refers to the natural or legal person who has created an account on the Platform; "Content" refers to any data, text, visuals, and reports created, uploaded, or processed through the Platform; "API" refers to the BON Influence programmatic access interface.
2. Account Use and Access Restrictions
2.1 Account Ownership and Personal Nature
Each account may only be used by the natural or legal person who created it. Accounts are personal and non-transferable. The account holder is exclusively responsible for the security of their account and for all transactions carried out through it.
2.2 Prohibition on Third-Party Use
You may not share your account credentials (including username, password, API keys, and access tokens) with any third party. You may not allow a third party to access your account, nor may you use your account on behalf of another person or organization. For corporate accounts, only employees authorized by the account-holding organization and invited through the Platform may gain access. Upon detection of unauthorized third-party access, your account will be immediately suspended or permanently closed, and this will not give rise to any right to a refund.
2.3 Account Security
You are obligated to use a strong password, change your password regularly, and notify us immediately if you suspect unauthorized access to your account. When two-factor authentication (2FA) is available, you are strongly advised to enable it.
3. Acceptable Use
3.1 Permitted Use
You may use the Platform solely for the purpose of managing, analyzing, and reporting on your influencer marketing campaigns, in accordance with these Terms and applicable legislation.
3.2 Prohibited Uses
The following actions are strictly prohibited and, if detected, may result in immediate termination of your account, initiation of legal proceedings, and claims for damages:
a) Data Scraping and Automated Data Collection
No data on the Platform may be collected, copied, reproduced, or extracted using automated tools, bots, crawlers, spiders, scrapers, or similar technologies. This prohibition applies to the Platform interface, APIs, and all data sources accessible through the Platform. Any attempt to conduct bulk data extraction, systematic data downloading, or automated data compilation is subject to legal action under Law No. 5846 on Intellectual and Artistic Works, Law No. 6698 (KVKK), GDPR, the Computer Fraud and Abuse Act (CFAA), and other applicable national/international legislation.
b) Reverse Engineering and Unauthorized Access
It is prohibited to attempt to reverse-engineer the Platform's source code, algorithms, data structures, or infrastructure, to obtain the source code (decompile, disassemble), to circumvent security measures, or to attempt to test them.
c) Data Theft and Unauthorized Data Use
It is prohibited to use data accessed through the Platform (including influencer data, campaign metrics, and analysis results) for commercial purposes outside the Platform, or to sell, rent, license, or transfer such data to any third party. Developing a competing product or service, creating a database, or enriching an existing database using Platform data is strictly prohibited.
d) Abuse
It is prohibited to use the Platform for illegal activities, spam, identity theft, fraud, or the creation or distribution of content that infringes the rights of others. It is prohibited to take actions that overload the Platform infrastructure or degrade service quality (e.g., DDoS, rate limit manipulation).
4. API Terms of Use
4.1 API Access
API keys are assigned solely to the account holder and may not be shared with third parties. API access must be used within the established rate limits.
4.2 API Restrictions
The following are strictly prohibited via the API: bulk data scraping, caching or systematically copying Platform data, using API keys across multiple applications or services, and sharing or republishing data obtained through the API with third parties.
5. Intellectual Property Rights
5.1 BON's Rights
The Platform is the exclusive intellectual property of BON Yazılım, Teknoloji ve Danışmanlık LTD. Şti. The Platform's design, source code, algorithms, database structures, graphical interface, logos, trademarks, and all content are protected by copyright and intellectual property legislation. The User is granted a limited, revocable, non-exclusive, and non-transferable license to use the Platform under these Terms.
5.2 User Content
The intellectual property rights to content you upload to the Platform belong to you. However, by uploading content to the Platform, you grant BON a limited license to process, store, and display that content for the purpose of providing and improving the Service.
6. Payment and Subscription
6.1 Pricing
Use of the Platform is charged according to the selected subscription plan. Prices are specified on the Platform or in the Subscription Agreement. BON reserves the right to update prices, provided that it gives at least 30 days' prior notice of any price changes.
6.2 Refund Policy
For monthly subscriptions, subscriptions not cancelled at least 7 days before the renewal date are automatically renewed. Applications submitted within the 14-day withdrawal period will be considered.
7. Service Level and Limitation of Liability
7.1 Service Level
BON makes reasonable efforts to ensure that the Platform is accessible 99.5% of the time; however, scheduled maintenance, force majeure events, and third-party service interruptions are excluded from this commitment.
7.2 Limitation of Liability
BON shall not be liable for indirect, incidental, special, or punitive damages arising from the use of the Platform. BON's total liability in any circumstance is limited to the total fees paid by the User in the 12 months preceding the relevant event.
7.3 Disclaimer of Warranties
The Platform is provided "as-is." BON makes no express or implied warranties regarding merchantability, fitness for a particular purpose, or non-infringement.
8. Contract Term and Termination
8.1 Contract Term
The duration of Platform access is limited to the term specified in the proposal and/or service agreement signed between the parties. Upon expiration of the contract term, Platform access will be automatically terminated unless a renewal is made.
8.2 Termination by User
The User may close their account in accordance with the termination conditions specified in the contract. For terminations made prior to the contract term, no refund of fees paid will be made unless otherwise stated in the proposal and contract.
8.3 Termination by BON
BON reserves the right to suspend or permanently close your account without prior notice in the event of a breach of these Terms. In particular, in cases of serious breaches such as data scraping, unauthorized access, account sharing, and data theft, termination will be applied immediately and no refund will be made.
8.4 Post-Termination
Following account termination or expiration of the contract term, your access to data on the Platform will end. Your right to request a copy of your data is preserved for 30 days from the termination or contract expiration date. After this period, your data will be permanently deleted.
9. Indemnification and Penalties
9.1 Indemnification Obligation
The User agrees and undertakes to indemnify BON, its employees, and its business partners for any and all damages, losses, costs, and expenses (including attorney's fees) incurred as a result of the User's breach of these Terms.
9.2 Special Sanctions for Data Scraping and Theft
BON reserves its rights to pursue criminal and civil action against individuals and organizations that engage in unauthorized scraping, copying, reproduction, or theft of Platform data, under Turkish Penal Code Arts. 243–244 (computer crimes), Law No. 5846 on Intellectual and Artistic Works, Law No. 6698 (KVKK), and relevant international legislation (GDPR, CFAA, etc.). BON has the right to claim a contractual penalty of a minimum of 50,000 TRY per detected violation.
10. Force Majeure
BON shall not be held liable for delays or impossibilities of performance arising from natural disasters, war, terrorism, epidemic disease, government decisions, infrastructure failures, cyberattacks, or other force majeure events beyond its control.
11. Dispute Resolution
11.1 Governing Law
These Terms shall be interpreted and governed by the laws of the Republic of Turkey.
11.2 Jurisdiction
Istanbul Courts and Enforcement Offices shall have exclusive jurisdiction over any and all disputes arising from or related to these Terms.
12. General Provisions
12.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
12.2 Waiver
BON's failure to exercise or delay in exercising any right shall not constitute a waiver of that right.
12.3 Amendments
BON reserves the right to update these Terms upon prior notice. Significant changes will be announced at least 30 days in advance by email or via an in-Platform notification.
12.4 Entire Agreement
These Terms, together with the Privacy Policy and the Subscription Agreement where applicable, constitute the entire agreement between the parties.
